Terms of Use and Privacy Policy
Halifax Regional Municipality has developed this application (the “Application”) to provide users with information, updates and resources related to the Cogswell District Redevelopment Project.
The following terms and conditions (“Terms”) govern your access to and use of the Application and any information, data, text, graphics, maps, photos or other materials (collectively referred to as “Content”) available through the Application. By accessing or using the Application you agree to be bound by these Terms. Halifax Regional Municipality may make changes to these Terms from time to time, without notice, at its sole discretion. It is your responsibility to read, understand and accept the Terms each time that you access the Application.
1. Using the Application
Halifax Regional Municipality gives you a personal, revocable, worldwide, royalty-free, non-assignable, non-exclusive licence to use the Application. This licence is for the sole purpose of enabling you to use and enjoy the benefit of the Application as provided by Halifax Regional Municipality, in the manner permitted by these Terms.
Use of this Application and the Content is at your own risk. This Application and all of its Content are provided “AS IS”. You must not rely on any Content published on or linked to this Application without first making your own enquiries to verify it is accurate, current and complete. When navigating within the Cogswell District, you must obey all official traffic signs, signals and instructions.
You acknowledge that all right, title and interest in and to the Application, including any intellectual property rights which subsist in the Application, are and will remain the exclusive property of Halifax Regional Municipality and its licensors.
Any feedback, comments or suggestions you may provide regarding the Application are entirely voluntary and Halifax Regional Municipality will be free to use such feedback, comments or suggestions as it sees fit and without any compensation or other obligation to you.
You agree that you will not interfere or attempt to interfere with the proper working of the Application.
2. Termination of Use
Without limiting other remedies, Halifax Regional Municipality may, in its sole discretion and without notice, temporarily or permanently discontinue the availability of the Application, and/or limit, suspend, or prohibit access to the Application for any reason whatsoever. Without limiting the foregoing, Halifax Regional Municipality may take technical and legal steps to keep users off the Application for any reason, including:
– if Halifax Regional Municipality believes that a user has violated or acted inconsistently with the letter or spirit of these Terms;
– if the Application is discontinued or materially modified by Halifax Regional Municipality; or
– if routine or unexpected maintenance is required for technical or security purposes.
3. Privacy & Personal Information
Your use of the Application is subject to Halifax Regional Municipality’s Website Privacy Statement.
In accordance with Section 485 of the Municipal Government Act (MGA), any personal information collected in this Application will only be used by Halifax Regional Municipality staff and, if necessary, individuals and/or organizations under service contract with the Halifax Regional Municipality for purposes relating to the redevelopment of the Cogswell District or to provide technical support for the app. If you have any questions about the collection and use of this personal information, please contact the Access and Privacy Office at 902-943-2148 or [email protected].
4. Disclaimer of Warranties
Halifax Regional Municipality does not make, and expressly disclaims, any representations, warranties, covenants and conditions, express or implied, arising out of operation of law, course of performance, course of dealing, usage of trade or otherwise, including any express or implied warranties and conditions of: merchantability; merchantable quality; fitness for a particular purpose; non-infringement; safety; quality; freedom from defects or that defects will be corrected; uninterrupted, virus-free or error-free use of this Application; or accuracy, currency, reliability, completeness or appropriateness relating to the Content of this Application.
5. Limitation of Liability
Under no circumstances will Halifax Regional Municipality, its councillors, officers, directors, employees, agents, representatives, partners and contractors have any responsibility or liability for any loss, injury or damage whatsoever (including without limitation direct, indirect, special, incidental, consequential, punitive, exemplary or other damages, and including without limitation to any loss of profit, costs, expenses, harm to business, business interruption, reputation, loss of information or programs or data, loss of savings, loss of revenue, loss of goodwill, loss of tangible or intangible property, legal fees or legal costs, wasted management or office time or damages of any kind whatsoever), whether based in contract, tort, negligence or any other legal basis, arising out of or in connection with this Application, any linked website or linked social media platform (including without limitation any damages suffered as a result of the use, inability to use, failure of, or any omissions or inaccuracies in, this Application, any linked websites or linked social media platforms, or any of the services or content of the foregoing), even if the Halifax Regional Municipality has been specifically advised of the possibility of such damage or loss, or if such damage or loss was foreseeable.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF HALIFAX REGIONAL MUNICIPALITY, ITS councillors, officers, directors, employees, agents, representatives, partners, and CONTRACTORS EXCEED ONE HUNDRED DOLLARS ($100.00).
6. Third Party Websites or Resources
The Application may contain links to third party websites, applications or resources. Halifax Regional Municipality provides these links only as a convenience and is not responsible for the content, products, or services on or available from those websites, applications or resources.
When accessing third party websites, applications or resources you are subject to the terms of use and privacy policies of such third parties.
To the extent permitted under applicable law, you acknowledge sole responsibility for and assume all risk arising from, your use of any third party websites, applications or resources.
7. Law and Forum for Disputes
The laws of the Province of Nova Scotia shall apply to the interpretation of these Terms, notwithstanding any conflicts of laws provisions. All proceedings relating to the Application or these Terms shall be brought before the courts of the Province of Nova Scotia.
8. Entire Agreement
These Terms represent the entire and exclusive agreement between Halifax Regional Municipality and you regarding the Application and your use of the Application. If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect.
